Acceptance of Terms of Use

Welcome to PetLuv, operated by Flamingo Inc, the app that allows You to connect with Your pets and other pet owners. These terms and conditions outline the rules and regulations for the use of “PetLuv” (or “the App”), available on iOS and Android devices.

By downloading, installing, or using this app, whether through a mobile device, mobile application or computer, You agree to be bound by these terms and conditions. If You do not agree to these terms and conditions, please do not use this app. Please read these terms and conditions (the “Terms”) carefully as they contain important information about Your legal rights, remedies and obligations. By accessing or using the “PetLuv”, You agree to comply with and be bound by these Terms. Please read it carefully. Thank You for using PetLuv! If You do not accept and agree to be bound by all of the terms of this Agreement, You should not access or use this App.

The following terminology applies to these terms and conditions, privacy policy, and disclaimer: "You" and "Your" refer to You, the user of this app. “We”, “Us”, and “Our” refer to PetLuv, the provider of this App. Together, You and PetLuv may be referred to as “Parties” and individually as “Party”.

1. Eligibility

By accessing and using PetLuv, You certify that You are at least 18 years of age or the age of majority in Your jurisdiction, whichever is higher, and a resident of the United States to use the App and Services.

By creating an account and using the Service, You represent and warrant that:

• You can form a binding contract with PetLuv;
• You are not a person who is barred from using the Service under the laws of the United States or any other applicable jurisdiction (for example, You do not appear in the U.S. Treasury Department’s list of Specially Designated Nationals or face any other similar prohibition);
• You will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations, including without limitation, privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements;
• You have not committed, been convicted of, or pled no contest to a felony, a sex crime, or any crime involving violence or a threat of violence, unless You have received clemency for a non-violent crime and we have determined that You are not likely to pose a threat to other users of Our Service and App, and that You are not required to register as a sex offender with any state, federal or local sex offender registry;
• You will use the latest version of the Service (via app or website);
• You do not have more than one account on the App;
• You have not previously been removed from the App by us, unless You have Our express written permission to create a new account; and
• You also certify that You will comply with all laws and regulations applicable to Your activities conducted through, or related to, this App.

If at any time You cease to meet these requirements, all authorization to access Our App or systems is automatically revoked, and You must immediately delete Your account.

2. User Account

In order to use PetLuv, You may sign in using a number of ways, including by Apple login, Google login or Facebook login. If You choose to use Your social login, You authorize us to access and use Your social media account information, including but not limited to Your public profile. For more information regarding the information we collect from You and how we use it, please consult Our Privacy Policy.

You are responsible for maintaining the confidentiality of the login credentials You use to sign up for PetLuv, and You are solely responsible for all activities that occur under those credentials. If You think someone has gained access to Your account without you consent, permission or knowledge, please immediately contact us.

3. User Content

This app allows You to create, upload, share, and interact with user content, such as photos, videos, messages, comments, ratings, reviews, and other materials. You are solely responsible for Your user content and the consequences of posting or sharing it. You represent and warrant that:

• You own or have the necessary rights and permissions to use and share Your user content
• Your user content does not infringe or violate any intellectual property rights, privacy rights, or other rights of any third party
• Your user content does not contain any defamatory, libelous, obscene, pornographic, abusive, hateful, harassing, threatening, or otherwise objectionable material.
• Your user content does not promote or endorse any illegal or unlawful activities or substances.

We do not claim any ownership rights over Your user content. However, by posting or sharing Your user content on this app, You grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, distribute, and display Your user content in connection with this app and Our business purposes. You also grant us the right to sublicense these rights to third parties. You understand and agree that we may delete, remove, or modify Your user content at any time for any reason without notice or liability to You.

We do not monitor, review, or endorse any user content on this app. We are not responsible for the accuracy, quality, or legality of any user content. We reserve the right, but not the obligation, to remove any user content that we deem to be in violation of these terms and conditions or otherwise inappropriate for this app.

4. User Interaction

This app allows You to interact with other users who share Your interest in pets. You are solely responsible for Your interactions with other users and any consequences that may arise from them. You agree to:

• Be respectful, courteous, and polite to other users.
• Not harass, abuse, threaten, or intimidate other users.
• Not solicit personal information, money, or favors from other users.
• Not send unsolicited or unwanted messages or requests to other users.
• Not impersonate or misrepresent Yourself or Your affiliation with any person or entity.
• Not engage in any illegal or unlawful activities or substances with other users

We do not screen, verify, or endorse any users on this app. We are not responsible for the conduct or behavior of any users. We reserve the right, but not the obligation, to monitor, report, or intervene in any disputes or issues between You and any other users.

We do not facilitate or arrange any meetings or interactions between You and any other users outside of this app. You are solely responsible for Your own safety and well-being when meeting or interacting with other users outside of this app. By using this App You agree to:

• Exercise caution, common sense, and good judgment when meeting or interacting with other users outside of this app.
• Not meet or interact with other users outside of this app if You have any doubts or concerns about their identity, intentions, or behavior.
• Not meet or interact with other users outside of this app in private or secluded places.
• Inform someone You trust about Your plans and whereabouts when meeting or interacting with other users outside of this app.
• Respect the rights, preferences, and boundaries of other users when meeting or interacting with them outside of this app.

We are not liable for any damages, losses, injuries, or harm that may result from Your meeting or interacting with other users outside of this app. You agree to release us from any claims or liabilities arising from Your meeting or interacting with other users outside of this app.

5. License

We grant You a limited, non-exclusive, non-transferable, revocable license to use this app for Your personal, non-commercial purposes, subject to these terms and conditions. You may not:

• Copy, modify, distribute, sell, or lease any part of this app or its content.
• Reverse engineer, decompile, or disassemble this app or attempt to extract the source code.
• Use this app for any illegal, unlawful, or unauthorized purposes.
• Use this app in any way that may harm or interfere with the operation of this app or any other users.
• Use this app to transmit any viruses, malware, or other harmful code or content.

6. Rights PetLuv grants You

PetLuv grants You a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use the App. This license is for the sole purpose of letting You use and enjoy the App’s benefits as intended by PetLuv and permitted by this Agreement. This license and any authorization to access the App are automatically revoked in the event that You do any of the following:

• use the Service or any content contained in the App for any commercial purposes without Our written consent.
• copy, cut, modify, transmit, create any derivative works from, make use of, or reproduce in any way any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content or proprietary information accessible through the Service without PetLuv’s prior written consent.
• express or imply that any statements You make are endorsed by PetLuv.
• use any robot, bot, spider, crawler, scraper, site search/retrieval application, proxy or other manual or automatic device, method or process to access, retrieve, index, “data mine,” or in any way reproduce or circumvent the navigational structure or presentation of the App or its contents.
• use the App in any way that could interfere with, disrupt or negatively affect the Service or the servers or networks connected to the Service.
• upload viruses or other malicious code or otherwise compromise the security of the App.
• forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted to or through the App.
• “frame” or “mirror” any part of the App without PetLuv’s prior written authorization.
• use meta tags or code or other devices containing any reference to PetLuv or the Service (or any trademark, trade name, service mark, logo or slogan of PetLuv) to direct any person to any other website for any purpose.
• modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the App, or cause others to do so.
• use or develop any third-party applications that interact with the Service or other members’ Content or information without Our written consent.
• use, access, or publish the PetLuv application programming interface without Our written consent.
• probe, scan or test the vulnerability of Our App or any system or network.
• encourage, promote, or agree to engage in any activity that violates this Agreement.

PetLuv may investigate and take any available and necessary legal action in response to illegal and / or unauthorized uses of the App, including termination of Your account.

Any software that we provide You may automatically download and install upgrades, updates, or other new features. You may be able to adjust these automatic downloads through Your device’s settings.

7. Rights You Grant PetLuv.

By creating an account, You grant to PetLuv a worldwide, transferable, sub-licensable, royalty-free, right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, reformat, incorporate into other works, advertise, distribute, and otherwise make available to the general public information You authorize us to access from third parties such as Facebook, Google, or Apple, as well as any information You post, upload, display or otherwise make available (collectively, “post”) on the App or transmit to other members (collectively, “Content”).

PetLuv’s license to Your Content shall be non-exclusive, except that PetLuv’s license shall be exclusive with respect to derivative works created through use of the Service. For example, PetLuv would have an exclusive license to screenshots of the Service that include Your Content.

In addition, so that PetLuv can prevent the use of Your Content outside of the Service, You authorize PetLuv to act on Your behalf with respect to infringing uses of Your Content taken from the App by other members or third parties. This expressly includes the authority, but not the obligation, to send notices pursuant to 17 U.S.C. § 512(c)(3) (i.e., DMCA Takedown Notices) on Your behalf if Your Content is taken and used by third parties outside of the Service. Our license to Your Content is subject to Your rights under applicable law (for example laws regarding personal data protection to the extent any Content contains personal information as defined by those laws) and is for the limited purpose of operating, developing, providing, and improving the Service and researching and developing new ones. You agree that any Content You place or that You authorize us to place on the Service may be viewed by other members and may be viewed by any person visiting or participating in the Service (such as individuals who may receive shared Content from other PetLuv members).

You agree that all information that You submit upon creation of Your account, including information submitted from Your Facebook account, is accurate and truthful and You have the right to post the Content on the App and grant the license to PetLuv above.

You understand and agree that we may monitor or review any Content You post as part of the Service. We may delete any Content, in whole or in part, that in Our sole judgment violates this Agreement or may harm the reputation of the Service.

When communicating with Our customer care representatives, You agree to be respectful and kind. If we feel that Your behavior towards any of Our customer care representatives or other employees is at any time threatening, harassing, demeaning or offensive, we reserve the right to immediately terminate Your account.

In consideration for PetLuv allowing You to use the Service, You agree that we, Our affiliates, and Our third-party partners may place advertising on the App. By submitting suggestions or feedback to PetLuv regarding Our Service, You agree that PetLuv may use and share such feedback for any purpose without compensating You.

You agree that PetLuv may access, store, and disclose Your account information and Content if required to do so by law, by performing its agreement with You, or in a good faith belief that such access, storage or disclosure satisfies a legitimate interest, including to: (i) comply with legal process; (ii) enforce the Agreement; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to Your requests for customer service; or (v) protect the rights, property or personal safety of the Company or any other person.

8. Payment

PetLuv is generally free to use. However, to use and enjoy advanced features in the App, the user will be required to pay through a membership plan in the App.

All payments charged through the PetLuv App will be billed in US Dollar (US$). PetLuv will not be responsible for international purchase fees or exchange rates.

With regard to the membership payment plans, a legally binding agreement between the Company and You will come into existence at the time of purchase when we receive Your first payment. This agreement means that You are required to complete all payments included in Your chosen payment plan unless You cancel membership within the time allowed. Upon cancellation, You will still be able to use the free membership without the advanced features.

9. Membership

The App is free to use and one need not pay anything to use. However, there are three levels of membership, and each comes with distinct advanced features. Should You want to enjoy the features, You will be required to subscribe to any of the levels based on Your preferred membership plan.

We may at Our absolute discretion refuse membership to any user and we shall not be obliged to state Our reasons for such refusal.

10. Cancellations and Refunds

The company does not offer refunds. If You as a member wish to cancel a membership, once it has been paid for, membership will last till the end of the paid for period after which their membership will not be renewed.

PetLuv Cancellation

PetLuv, in its sole discretion, for any reason or no reason, with or without notice (i) terminate or suspend Your account and Your access to the App, and/or (ii) remove Your Profile and/or any content posted by or about You, from the App.

Unless otherwise decided by PetLuv, such termination, suspension, and/or removal will be effective immediately. Following any termination or suspension of any User's account, PetLuv may send a notice of the termination or suspension to other Users You have corresponded with. If Your account has been terminated by PetLuv, You may not re-register without PetLuv's consent (and if You are permitted to re-register, Your previous information and activity, including any fee credits, may no longer be available).

User Cancellation.

As a User, You may cancel Your account at any time through the App or by contacting Our customer support team.

Effect of Termination.

Upon the termination or cancellation of Your account, You will have access to the App’s features for the membership plan You subscribed to till the end of Your subscribed plan period. If Your account is terminated or canceled, Your Profile will no longer be displayed after the end of the period subscribed, but other User Content You have posted or transmitted (e.g., Reviews, messages to other Users) may or may not (in Our sole discretion) remain on the App. Any User Content associated with Your account after Your account's termination or cancellation may not be available to You if You re-register with PetLuv. If following the termination or cancellation of Your account, You continue to access and use other portions of the App, Your use will continue to be governed by these Terms.

11. Intellectual Property Rights

This app and its original content, features, and functionality are owned by PetLuv and are protected by international copyright, trademark, patent, trade secret, and other intellectual property rights laws. You acknowledge and agree that You have no right, title, or interest in or to this app or its content except as expressly granted by these terms and conditions. You agree not to infringe or violate any of Our intellectual property rights or those of any third party.

12. Privacy Policy

We respect Your privacy and are committed to protecting Your personal information. Your privacy is at the core of Our business. You are responsible for maintaining the confidentiality of Your account information, including Your username and password. You are responsible for all activities that occur under Your account, and You agree to notify us immediately of any unauthorized access or use of Your account. We are not responsible or liable for any damage or loss related to any unauthorized access or use of Your account, including without limitation, as a result of phishing or other similar attacks.

13. Disclaimer

This app is provided on an "as is" and "as available" basis without any warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability. We do not warrant that this app will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the results obtained from this app will be accurate or reliable. We do not warrant that any defects or errors in this app will be corrected.

PetLuv users are not under the direction or control of us, and neither are the users’ pets. We do not provide and are not responsible or liable in any manner for the identity verifications, and we do not endorse or make any representations or warranties regarding the reliability of such identity verifications or the accuracy, timeliness or completeness of any information in the identity verifications. We do not independently verify information relating to the users or their pets.

By using PetLuv, users agree to waive any claims, rights, or legal action against PetLuv, its affiliates, and partners for injuries, harm, or damages caused by either the pets or the users. Users are encouraged to take necessary precautions and exercise sound judgment when engaging in activities with pets or other users through the platform."

14. Notice and Procedure for Making Claims of Copyright Infringement.

If You believe that Your work has been copied and posted on the App in a way that constitutes copyright infringement, please contact us, please be sure to include the following information:

• an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
• a description of the copyrighted work that You claim has been infringed;
• a description of where the material that You claim is infringing is located on the Service (and such description must be reasonably sufficient to enable us to find the alleged infringing material);
• Your contact information, including address, telephone number and email address, and the copyright owner’s identity;
• a written statement by You that You have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
• a statement by You, made under penalty of perjury, that the above information in Your notice is accurate and that You are the copyright owner or authorized to act on the copyright owner’s behalf.

PetLuv will terminate the accounts of repeat infringers.

15. Third Party Services.

The App may contain advertisements and promotions offered by third parties and links to other web sites or resources. PetLuv is not responsible for the availability (or lack of availability) of such external websites or resources. If You choose to interact with the third parties made available through Our App, such party’s terms will govern their relationship with You. PetLuv is not responsible or liable for such third parties’ terms or actions.

16. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any damages of any kind arising from or relating to Your use of or inability to use this app, including but not limited to direct, indirect, incidental, consequential, special, exemplary, or punitive damages. This limitation of liability applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the above limitations may not apply to those users in those jurisdictions.

17. Indemnification

You agree to indemnify, defend, and hold harmless PetLuv and its affiliates, officers, directors, employees, agents, partners, and licensors from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use of or inability to use this app or any user content.
• Your violation of these terms and conditions or any applicable law or regulation
• Your violation of any rights of any third party, including intellectual property rights, privacy rights, or other rights.
• Any dispute or issue between You and any other user or third party.

We reserve the right, at Our own expense, to assume the exclusive defense and control of any matter subject to indemnification by You, and You agree to cooperate with us in such defense. You agree not to settle any claim without Our prior written consent.

We do not provide any representations or warranties about the quality or conditions of Pets You interact with in and/ or through the App and with the Pet Owners. We also do not provide any representations and warranties about the interactions and dealings with other users.

18. Termination

We may terminate or suspend Your access to this app at any time, for any reason, without notice or liability to You. We may also terminate or suspend Your account and delete or remove Your user content at any time, for any reason, without notice or liability to You. Upon termination of Your access or account, Your right to use this app and Your user content will immediately cease. All provisions of these terms and conditions that by their nature should survive termination shall survive termination, including but not limited to intellectual property rights, disclaimer, limitation of liability, indemnification, and governing law.

19. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in the United States of America for any legal action or dispute arising from or relating to these terms and conditions or Your use of this app.

20. Changes to These Terms and Conditions

We may revise and update these terms and conditions at any time and for any reason, without notice or obligation to You. You are responsible for reviewing these terms and conditions periodically for any changes. Your continued use of this app after we post any changes constitutes Your acceptance of those changes.

21. Entire Agreement; Other.

This Agreement, which includes the Privacy Policy, and any terms disclosed to You if You purchase or have purchased additional features, products or services we offer on the Service, contains the entire agreement between You and PetLuv regarding Your relationship with PetLuv and the use of the Service, with the following exception: anyone who opted out of the retroactive application of Clause 15 is still subject to and bound by any prior agreements to arbitrate with PetLuv as well as this agreement to arbitrate on a going forward basis.

If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. The failure of PetLuv to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. You agree that Your PetLuv account is non-transferable and all of Your rights to Your account and its Content terminate upon Your death. No agency, partnership, joint venture, fiduciary or other special relationship or employment is created as a result of this Agreement and You may not make any representations on behalf of or bind PetLuv in any manner.
